Firm sued over Harry Popper
Hollywood studio Warner Brothers is suing a Swiss company over a brand of condoms – called Harry Popper.
Magic X's packaging for its condom range features a cartoon-like image of a condom clutching a wand and sporting round-rimmed spectacles.
Warner Bros, which produced the Harry Potter film franchise, claims the contraceptive brand infringes copyright and has taken its case to the Cantonal Court in Schwyz.
A Warner Bros lawyer said: "The image of my client is in danger. This is clearly a reference to the film and fictional character Harry Potter. Everyone who sees the condoms automatically thinks of Harry Potter.”
But a lawyer for Magic X, which began selling the brand in 2006 and registered the name with Swissreg, the Swiss Federal Institute of Intellectual Property, said: “Our product has nothing to do with Harry Potter.”
A ruling on whether the product should be banned will be made in the next few weeks.
